Personal data, data processing (processing purposes and legal bases)

Personal data includes all information that can be used to determine your identity. This includes information such as your name, address, postal address, telephone number, email address, subject and your message.

This does not include information that is not associated with your identity (such as the number of users of the site). In principle, you can use our website without disclosing your identity.

Personal data are collected when you voluntarily provide us with them, for example when you contact us. This is necessary in order to process your request. We use the personal data transmitted to us in this way exclusively for the purpose that you provide them for when contacting us. A communication of this information is expressly made on a voluntary basis and with your consent (Art. 6 para. 1 sentence 1 lit. (a) GDPR).

In the case of orders (e.g. information material, brochures), the personal data entered (first name, surname, company, street/house number, postcode, city, email address) will only be used by the LBGR and the companies commissioned to send the brochures to you for the purpose of sending the desired publication or for corresponding with you.

You have the right to withdraw your consent to data processing at any time (Art. 7 para. 3 GDPR). In this case we will erase your data under the condition of Art. 17 GDPR.

Each time a user accesses a page of the website of the State Government of Brandenburg and each time a file is retrieved, data on this process are stored in a log file. These data are not personal, so we cannot trace which user retrieved which data.

In detail, the following data record is stored for each retrieval:

Name of the retrieved file,

• Date and time of retrieval,
• Volume of data transferred,
• Message confirming that the retrieval was successful,
• Description of the type of web browser used.

 

The IP address of the computer from which the request was sent is not stored. Personal user profiles can therefore not be created. The stored data are only evaluated for statistical purposes. The data will not be disclosed to third parties.

When using the website, so-called cookies are used. Cookies are small text information files that are sent from our Internet website and are stored on your computer by your browser during the access. You can prevent the use of cookies by deactivating the cookie function in your browser. If you do so, however, you may not be able to make full use of all the functions of the Ministry's website. For information on how to prevent the use of cookies, please refer to the instructions of your browser manufacturer.

Applications

We process data that you have sent to us in connection with your application in order to check your suitability for the position and to carry out the application process.

The legal basis for the processing of your personal data in this application procedure is primarily Section 26 of the Brandenburg Data Protection Act in the version applicable from 25/05/2018. Accordingly, the processing of the data required in connection with the decision on the establishment of an employment relationship is permissible.

Should the data be necessary for prosecution after completing the application procedure, if applicable, data processing may be carried out on the basis of the requirements of Art. 6 GDPR, in particular to safeguard legitimate interests pursuant to Art. 6 para. 1 lit. (f)) GDPR. Our interest then lies in the assertion or defence of claims.

Duration of storage

The personal data we receive by email or contact form will be erased as soon as the storage is no longer necessary to achieve the purpose intended or in connection with the administrative procedures initiated and the relevant storage obligations (Section 6 Art. 2 of the Common Rules of Procedure for the Ministries of the State of Brandenburg of 15 March 2016 in conjunction with Section 7 of the Directive for the Processing and Administration of Documents in the Brandenburg State Administration – Registration Directive and File Plan of the Ministry of Economic Affairs and Energy). If you unsubscribe from a newsletter or after delivery of information material, your data will be erased immediately.

Disclosure of personal data to third parties

Any personal data you enter will only be used for the purpose you have requested and only within the State Government or the authorities, offices and institutions commissioned with the respective service. We shall not disclose them to third parties without your express consent. Insofar as we are obliged to do so by law or by court order, or the disclosure is necessary in the event of attacks on the Internet structure of the State Government for legal and criminal prosecution, we will transfer your data to bodies entitled to receive information.

Protection of minors

Children and persons below the age of 16 years should not provide us with any personal data without the consent of their parents or legal guardians, unless their parents or persons having the care and custody (holders of parental responsibility) have given their consent (Art. 8 para. 1 GDPR). The consent must be explicitly stated in the message (Art. 8 para. 2 GDPR). We do not request personal data from children and young people, we do not knowingly collect them and do not disclose them to third parties.

Your rights

Pursuant to the General Data Protection Regulation, you shall be entitled to the following rights:

If your personal data are processed, you shall have the right to obtain information about the data stored concerning your person (Art. 15 GDPR).

In case that inaccurate personal data are processed, you shall have the right to rectification (Art. 16 GDPR).

If the legal requirements are given, you may request the erasure or restriction of the processing and object to the processing (Art. 17, 18 and 21 GDPR).

If you have given your consent to data processing or a data processing contract exists and data processing is carried out using automated methods, you shall have a right to data portability, if applicable (Art. 20 GDPR).

In the event of giving consent to data processing, you shall have the right to withdraw such consent at any time (Art. 7 Para. 3 GDPR).

If you make use of the rights mentioned above, the public body will check whether the legal requirements for this have been met.

Right to lodge a complaint with the supervisory authority:

Pursuant to Art. 77 GDPR, you also have the right to lodge a complaint with the supervisory authority if you consider that the processing of your personal data is unlawful.
